These Terms of Service ("Terms") govern your use of the NearJobs mobile application and related services (the "Platform"), operated by NearJobs Inc. ("NearJobs", "we", "us"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
NearJobs is a neutral venue that connects people who need local services ("Clients") with independent service professionals ("Providers"). Clients post service requests; Providers respond with offers.
NearJobs is not a party to any agreement between Clients and Providers. We do not employ Providers, supervise work, set prices, or guarantee the quality, safety, legality, or completion of any job. Any contract for services is formed directly between the Client and the Provider, and they alone are responsible for performing and paying for it.
You must be at least 18 years old and able to form a binding contract to use the Platform. By using the Platform you confirm this is true. Providers must hold any licence, permit, or insurance required by law for the services they offer.
You agree to provide accurate information when creating an account and to keep it current. You are responsible for all activity under your account and for keeping your credentials secure. Account types (Client or Provider) are selected at sign-up. We may suspend or terminate accounts that violate these Terms.
All payments for services are made directly between the Client and the Provider, outside the Platform. NearJobs does not process job payments, hold funds in escrow, issue invoices, or collect or remit taxes on either party's behalf. Each party is solely responsible for their own tax, invoicing, and record-keeping obligations. Income figures shown in the Platform's provider tools reflect amounts Providers self-report and are not verified by NearJobs.
Providers may purchase subscription plans or lead credits to access matched opportunities. Subscription fees are billed as described at the point of purchase and are non-refundable except where required by law or the applicable app store's policies. We may change plan pricing or features with reasonable advance notice.
Verification badges and trust scores are informational tools based on documents submitted, platform activity, and review history. They are not an endorsement, guarantee, or warranty of any person's identity, skill, honesty, or work quality. You are responsible for exercising your own judgment before hiring or accepting work, including verifying licences and insurance where relevant.
After a completed job, Clients and Providers may review each other. Reviews must reflect a genuine, first-hand experience. You may not offer or accept anything of value in exchange for reviews, review yourself, or use reviews to threaten or extort. We may remove reviews that violate these Terms, but we do not routinely edit or verify reviews and are not responsible for their content.
You retain ownership of the content you post — job descriptions, photos, profile details, messages, and reviews ("User Content"). You grant NearJobs a non-exclusive, worldwide, royalty-free licence to host, display, and distribute your User Content solely to operate and promote the Platform. You confirm you have the rights to any content you post, and that it does not infringe anyone else's rights.

We may investigate violations and suspend or terminate accounts, remove content, and, where appropriate, report activity to authorities.
Meeting people from the internet and performing physical work both carry inherent risk. Use good judgment: verify credentials, meet in appropriate settings, and comply with applicable safety regulations. NearJobs does not conduct background checks unless expressly stated in a specific feature.
Disputes about a job — quality, payment, damage, cancellation — are between the Client and the Provider. We encourage users to resolve disputes directly through the Platform's messaging. NearJobs has no obligation to mediate, but may, at its discretion, take account-level action (such as removing content or suspending accounts) based on documented conduct.
The Platform is provided "as is" and "as available". To the maximum extent permitted by law, NearJobs disclaims all warranties, express or implied, including fitness for a particular purpose, and does not warrant that the Platform will be uninterrupted, error-free, or secure, or that any job will be completed or paid for.
To the maximum extent permitted by law, NearJobs and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Platform or from any interaction between users — including property damage, personal injury, or payment disputes arising from jobs. Where liability cannot be excluded, our total aggregate liability is limited to the greater of (a) the amounts you paid NearJobs in the 12 months before the claim, and (b) CAD $100. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
You agree to indemnify and hold NearJobs harmless from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Platform, your violation of these Terms, or your interaction with any other user, including any job performed or requested.
You may delete your account at any time. We may suspend or terminate your access at any time for violation of these Terms or to protect the Platform or its users. Sections that by their nature should survive termination (including Sections 9, 13–15, and 18) survive.
We may update these Terms from time to time. If changes are material, we will give notice in the app or by email before they take effect. Continued use of the Platform after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. You agree to the exclusive jurisdiction of the courts of Ontario for any dispute with NearJobs, except where the law of your place of residence grants you non-waivable rights to bring claims locally.
