This Privacy Policy explains how NearJobs Inc. ("NearJobs", "we", "us") collects, uses, shares, and protects personal information when you use the NearJobs mobile application and related services (the "Platform"). We comply with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.
1. Information we collect
Information you provide:
Account details — name, email address, password, and account type (Client or Provider).
Profile information — for Providers: business name, description, service categories, service areas, portfolio photos, and credentials submitted for verification.
Job content — service requests you post, including descriptions, budgets, photos, city and neighbourhood, and preferred timing.
Offers and job activity — quotes, messages, attachments, reviews, ratings, and payment amounts Providers choose to self-report in income tools.
Communications with us — support requests and correspondence.
Information collected automatically:
Device and usage data — device type, operating system version, app version, language, crash logs, and how you interact with Platform features.
Approximate location — the city/area you provide for jobs or service areas. We do not track your precise GPS location in the background.
Information from third parties:
If you sign in with Google or Apple, we receive your name and email address from that provider, as permitted by your settings with them.
2. How we use information
We use personal information to:
Operate the Platform — create accounts, publish requests, deliver offers, enable messaging, notifications, alerts, and reviews;
Match Providers with relevant requests based on category and area;
Display reputation information (ratings, reviews, trust indicators) that makes the marketplace work;
Process Provider subscriptions and lead credits;
Maintain safety and integrity — investigate violations, prevent fraud and spam, and enforce our Terms of Service;
Improve the Platform — debugging, analytics, and feature development;
Communicate with you about your account, transactions, and (with your consent) product updates;
Meet legal obligations.
We do not use your personal information for automated decision-making that produces legal effects about you, and we do not sell personal information.
3. What other users can see
NearJobs is a marketplace, so some information is visible to other users by design:
Job posts (title, description, photos, budget, city/area, timing, your first name) are visible to Providers browsing the Platform;
Provider profiles (business name, description, portfolio, categories, areas, ratings, reviews, badges) are visible to all users;
Offers you send are visible to the Client who posted the request;
Messages are visible to the other party in the conversation;
Reviews you write are visible with your display name.
Do not include information in public content (such as your exact address or phone number) that you don't want other users to see. Share precise contact and address details through private messages only when you choose to.
4. When we share information
We share personal information only:
With other users, as described in Section 3;
With service providers who process data on our behalf under contract — hosting and database services (our infrastructure is currently hosted with Google Firebase on servers located in the United States), authentication providers (Apple, Google), app distribution (Apple App Store), and crash/analytics tooling;
For legal reasons — when required by law, court order, or lawful request, or to protect the rights, safety, or property of NearJobs, our users, or the public;
In a business transfer — if NearJobs is involved in a merger, acquisition, or asset sale, with notice to you where required.
Because some service providers store data outside Canada, your information may be subject to the laws of those jurisdictions while stored there. We use contractual and technical safeguards with all processors.
5. Retention
We keep personal information only as long as needed for the purposes above:
Account and profile data — for the life of your account and up to 12 months after deletion, unless a longer period is required by law;
Job posts, offers, messages, and reviews — while your account is active; when you delete your account, content is deleted or de-identified, except reviews may remain in de-identified form to preserve other users' review history integrity;
Records needed for legal, tax, or dispute purposes — as required by applicable law.
6. Your rights
Subject to applicable law, you may:
Access the personal information we hold about you;
Correct inaccurate or incomplete information (most profile data can be edited in the app);
Delete your account and associated personal information;
Withdraw consent to optional processing (such as marketing messages) at any time;
Complain — if you are unsatisfied with our response, you may contact the Office of the Privacy Commissioner of Canada.
To exercise these rights, contact us at support@nearjobs.ca. We respond to verified requests within 30 days.
7. Security
We use industry-standard safeguards to protect personal information, including encryption in transit, access controls, and row-level security on our databases. No system is perfectly secure; if a breach creates a real risk of significant harm, we will notify affected users and the Privacy Commissioner as required by law.
8. Children
The Platform is for adults 18 and over. We do not knowingly collect personal information from anyone under 18. If we learn we have done so, we will delete it promptly.
9. Push notifications
With your permission, we send push notifications about offers, messages, matches, and reviews. You can turn these off in your device settings at any time.
10. Changes to this policy
We may update this policy from time to time. If changes are material, we will notify you in the app or by email before they take effect. The "Last updated" date at the top shows the current version.
